Employee responsibilities after a workers’ compensation claim

After suffering an injury on the job, workers’ compensation provides financial support for employees who are unable to work. Employers have a responsibility to provide workers’ compensation coverage for employees. Employees also have responsibilities when it comes to handling their injuries.

Understand your responsibilities to preserve your right to workers’ compensation benefits.

Report the injury in a timely manner

As soon as an injury occurs, you should notify your supervisor or employer. The sooner the better, and no later than 30 days of the accident. Your employer will fill out an injury report and provide you with a copy. Review that report for accuracy before you leave.

Get medical attention if needed

Depending on the nature of the injury, you may need medical attention. An injury you consider minor could become more severe without proper medical attention. It is important to consult a doctor as soon as possible.

Cooperate with requests

You may receive requests from the workers’ compensation insurance company, including a request for an independent medical examination. You should cooperate with those requests. Refusal on your part could result in denied benefits.

Behave responsibly

After suffering an injury at work, you should act in a responsible manner. Avoid behaviors that could indicate that your injuries are not as severe as you claim, including shoveling snow, climbing ladders and similar behaviors. The workers’ compensation insurance carrier may have a private investigator follow you as part of their assessment.
